1. USE RESTRICTIONS
The ESPON Programme, by these terms and conditions of use, allows the visitor a non-exclusive and non-transferable right to access to the ESPON Database Public Files. The user/visitor is responsible for providing all software and equipment needed to access this service. “User/Visitor” means the company, entity, or individual installing or using the ESPON Database Public Files. "Use" means storing, loading, installing, executing, or displaying the ESPON Database Public Files.
The visitor may use the data included in the ESPON Database Public Files, including the production of derivative works for the purpose of illustration for teaching or for another professional or personal use without making financial profit.No material may be modified, edited or taken out of context such as its use creates a false or misleading statement or impression of the content of the ESPON Programme. Moreover the visitor does not have any right to sell or redistribute the information included in the ESPON Database Public Files.

The ESPON Programme shall have the right to terminate users ability to access this service at any time without notice and also reserves the right to discontinue or modify any of the information contained on this service, or the service, at any time.

2. LIMITATION OF LIABILITY
The user of this system assumes all responsibility and risk for the use of this server and the Internet generally. The ESPON Programme disclaim all warranties, representations or endorsements, express or implied, with regard to the information accessed from, or via, this server or the internet, including, but not limited to, all implied warranties of merchantability, fitness for a particular purpose, or non infringement. In no event shall ESPON be liable for any compensatory, special, direct, incidental, indirect, consequential damages, exemplary damages or any damages whatsoever resulting from loss of use, data, or profits, whether in an action of contract, tort or otherwise, arising out of or in connection with the use or performance of the information on this server or the internet generally or on any other basis.
ESPON warrants that the information on this server or on the Internet generally will be uninterruptible or error free or that any information, software or other material accessible from the server is free of viruses or other harmful components.

3. SERVICE COMMITMENT
The ESPON Programme reserves its exclusive right in its sole discretion to alter, limit or discontinue the site or any Materials in any respect. The ESPON Programme shall have no obligation to take the needs of any visitor into consideration in connection therewith.

4. OWNERSHIP
The ESPON web-GIS is protected by copyright and other laws respecting property rights. ESPON Database Public Files is a shared property of ESPON Programme.

5.APPLICABLE LAW
The use of the ESPON Database Public Files is subject to existing laws and legal process. The Terms and Conditions of Use of the ESPON Database Public Files shall be governed by the laws of Grand Duchy of Luxembourg. Any dispute arising shall be subject to the personal and exclusive jurisdiction and venue of the Grand Duchy of Luxembourg.

  • Loi du 18 avril 2001 - droits d'auteur, les droits voisins et les bases de données

The visitor acknowledges having read these Terms and Conditions agrees to abide by them. The visitor also agrees that the Terms and Conditions supersede all proposals and/or prior agreements, oral and written, and any other communications between the parties.
